By accessing, browsing, or using the Site in any way, you represent that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must immediately leave the Site.

4. Intellectual Property

You are granted a limited, revocable, non-exclusive, non-transferable licence to access and view Site content for your personal, non-commercial use only. You may not:

• Use any character likenesses, artwork, or branding for commercial purposes;

• Create deepfakes, synthetic media, or AI-generated content using our characters or visual style;
• Remove or alter any copyright, trademark, or other proprietary notices.

Violations of this section may result in immediate termination of your access and legal action.

5. Digital Subscriptions & Purchases

Digital content subscriptions and purchases are processed through Fansly, an independent third-party platform. Your subscription relationship is governed by Fansly's own Terms of Service and Privacy Policy in addition to these Terms.

All digital content is licensed, not sold. Purchasing access to content does not transfer ownership of any intellectual property. We reserve the right to modify, remove, or discontinue any content at any time without liability.

Refund policies for digital content are governed by Fansly's policies. We do not control or guarantee refund processing on Fansly's platform.

6. Acceptable Use

TO THE FULLEST EXTENT PERMITTED BY LAW, JIGOKU FLOWER LABS LLC DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses. We reserve the right to modify, suspend, or discontinue the Site at any time without notice or liability.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL JIGOKU FLOWER LABS LLC, ITS MEMBERS, OFFICERS, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL) ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

In jurisdictions that do not allow the exclusion or limitation of certain damages, our liability shall be limited to the maximum extent permitted by law.

11. Indemnification

You agree to indemnify, defend, and hold harmless Jigoku Flower Labs LLC and its members, officers, agents, and licensors from and against any claims, liabilities, damages, costs, and expenses (including reasonable legal fees) arising from your use of the Site, your breach of these Terms, or your violation of any applicable law.

12. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law principles.

Any dispute arising out of or relating to these Terms or your use of the Site shall first be subject to good-faith informal negotiation. If not resolved within 30 days, disputes shall be submitted to binding arbitration under the rules of the American Arbitration Association, conducted in Sheridan County, Wyoming, on an individual basis. You waive any right to participate in a class action proceeding.

McGill carve-out: Notwithstanding the foregoing arbitration agreement and class action waiver, nothing herein waives your right to seek public injunctive relief in a court of competent jurisdiction, as provided under California Civil Code §3513 and as interpreted by McGill v. Citibank, N.A., 2 Cal.5th 945 (2017). Any claim for public injunctive relief shall be adjudicated in court and severed from any arbitrable claims.

Nothing in this section shall prevent either party from seeking injunctive or other equitable relief in any court of competent jurisdiction to protect intellectual property rights.

This site is exempt from the record-keeping requirements of 18 U.S.C. § 2257 and 28 C.F.R. § 75 as no actual human beings appear in any content produced or displayed herein.
